Annulment is a process by which a marriage is dissolved because of various reasons one of which is irreconcilable differences. Nullification, on the other hand, is a process that stops the marriage from continuing because it is null and void or invalid from the start. One reason is that one of the contracting parties was a minor at the time of marriage.

Annulment and Nullification (Null is the key word ) are the same in the Philippines , it just says that the marriage from the beginning is null and void because one of the partner has Psychological incapacity to contract the marriage (before the marriage that partner has already exhibit y that incapacity ) or that some requirement like permission of parent for minors was not obtained , some documentary requirement was not fulfilled before the marriage.


One most accepted for Annulment is the Psychological incapacity , so you have to have a Psychologist attesting to the mind set of the partner being accused as the party at fault . The marriage will not be annulled if the judge found out that there is connivance on both parties to annul marriage , or the marriage will be annulled because one partner has an extra marital affair , you could only get legal separation .





If one of the party accused for being at fault do not attend the hearing in three separate hearings then the annulment case even with proper notification , will be judged according to the pleadings with the judge and could be sh 6 months , if adversarial then could take two years .My brother in Law's annulment even the wife in US could not attend , it took him more than three years.     I was in the supermarket tonight and say more than a few (apparently) unmarried couples shopping together. My guess is they're cohabitating. I wonder where this will go as we look back in a few decades.     It's not a fair comparison, because you would have to prove that you have ';equivalent life experiences.'; And guess what? We already have a system like that. It's called the GED. If you drop out of school and then decide to have a high school diploma, you have to take a test to prove you have similar knowledge as one who stayed in high school until graduation. If you pass the test, you get your GED - which is pretty much the same as a high school diploma. With a GED you can get into college, get better jobs, etc. Does it have any affect on those who stayed in school? Not really. People who choose to drop out pretty much already have their minds made up, and it's up to them to get their GED if they so choose. The ones that want to stay in school do just that. Just because there are multiple ways to get the same thing doesn't mean that one way is better than another. We all need individual paths in order to reach the same goal.





    The point is, marriage is a personal RIGHT, and every human being should receive the same rights. It's pretty plain and simple. No government has any right to tell human beings whom they are allowed to marry or give special privileges to certain couples but not others. Make it equal, or do away with marriage altogether.

    I used to go to conservative churches that teach that abstinence crap, and I learned that the leaders of these churches actually crack jokes about 30 and 40 year-old virgins behind their backs. I saw the testimony of an ex homosexual not to long ago who had become Christian, and he was dying on his death bed with aids, and a Christian pastor who had lead him to Christ went into see him, and he told the pastor before dying he said '; Please don't stop preaching to homosexuals about Christ, they know their life style is wrong, they are just in denial about it'; and he went on to tell the pastor, that some of the most militant homosexuals are the ones who's conscience convict them the most, which is the reason for their behavior.     I guess some people just don't figure they're worth much more than a lousy partner is willing to give them. For me, a child outside the boundaries of our relationship would be the demise of what we have together. I could not be with him any longer.     I came home to my wife and told her that my mistress was pregnant and that was 20 years ago. She quit working at Sears and left with my baby and I never seen her again. To this day I don;t even know if it was a boy or a girl.
    Dealing with my hubbys affair has been difficult enough, almost impossible, but if there were the everyday reminder of a child, I'm not sure I could survive it. She must really love him and she should have some really good karma coming her way--she is admirable.

    If I could find it in myself to forgive my husband then I would help to raise the child just like if they were mine. The child in this case should never be left out or mistreated due to the adults not acting like adults.

    This is like my worst nightmare. I would hate him! I don't think I would be able to get past that. I wouldn't want anything to do with the child even though the child is a victim as well. I would never want my husband to see the child or pay child support, but this is also not fair to the child. I would go crazy and probably kick his *** out and go to thereapy for years!
    Well you don't know what neither one of them is going through until you are in there shoes. She might not leave because she loves him and will do anything to keep him around, and same goes for him. You have to ask yourself what would you do and if it was you instead of them.     I came home to my wife and told her that my mistress was pregnant and that was 20 years ago. She quit working at Sears and left with my baby and I never seen her again. To this day I don;t even know if it was a boy or a girl.

    Personally, I would not be able to keep it. Especially if the marriage ended because of adultery or something painful like that. It would only remind me of the failed marriage and cause me extra pain.


    But if you love the ring and don't mind keeping it then of course change it over to the other hand. No sense in getting rid of something that you cherish/enjoy.

    I personally would go that route so that in the future you don't have to explain to some hot guy why you are still wearing your wedding ring, even if it is on a different hand.     Because the word marriage is a religious term meaning the joining of a man and a woman. So a man/man marriage defies the meaning of the word entirely. The government attempted at allowing ';unions';, which would be the exact same thing with the same benefits, but the gay rights folks turned it down. Seems the want the label over everything else.





    And by the way, I'm pro-gay marriage, I'm just stating what the controversy is.





    I totally agree MasterPy..., the logic is severely flawed.
    For many Bible believers, Jews, Muslims, Hindu, Buddhists, Baha'i and on and on, there is no way they can tolerate same sex marriage within their faith. They go on to attempt to prohibit people outside of their faith, by using the democratic process. This means that because a very solid majority of people wanted laws that defined what marriage could and could not be, we got those laws on the books.





    Just as an observation, while a majority may be willing to tolerate same sex marriage, we do not have a solid majority willing to endorse SSM. A clear majority has no interest in using permission for SSM. So, in absence of a clear majority in favor of abolishing laws prohibiting, the laws stay on the books.





    Then we have legal challenges, based on a concept that freedom should not be withdrawn by legislation unless that legislation is necessary. Now such a challenge in and of itself suggests that most other laws relating ot marriage, bigamy, polygamy, perhaps marriage to a sister or other close relative might be thrown out if the courts throw out the rule of one man and one woman, exactly in both cases. There does not appear to be any absolute necessity for restricting the freedom of people for any of these laws any more than the rest. At least we see a whole deck of cards about to collapse if this principle is supported in this case.





    Seeing this, not only religious people but a large contingent of others do not want to apply this legal principle to marriage. Many women do not want to leave the option of polygamy open to their spouses.





    OK, we have a lot of opposition. We dare not even consider this. Yet court challenges are presented and we must be prepared to present in court. Some governments simply do not want to spend their time fighting this in court, particularly when courts have concluded that SSM should have the same legal footing as Hetero marriage. Canada for example had had clear statements from its government that they were going to firmly support the historic standing of traditional marriage, then the supreme court told the government that they would not be able to enforce the old law, they had to rewrite the law to conform to the charter of rights, or remove the restriction against SSM.





    Despite vehement support for the existing laws, the old law collapsed..





    Our Parliament debated but could not find a way to retain this restriction. So we still have permitted SSM.





    Based on the principle, as distinct from the explicit wording, it would appear that mandatory monogamy within marriage would likewise be open to challenge.





    Well, in principle already people can be polygamous if they do not go through the ritual of marriage, do not attempt to register subsequent marriages.





    And this leads into the question of civil unions. Recognizing civil unions of gays within the mandatory monogamous rules is a compromise. Gays get to be married in principle but must be monogamous. Both sides won. But it leaves the more fundamental issue, whether the state has any place in the bedrooms of the nation, deciding who may and may not be there as much up in the air as ever.
    It's hard to explain flawed logic. Some people think marriage has something to do with God even though the government keeps the records and Atheists are allowed to get married.

    Validity of Hindu Marriage Ceremonies is based on section 7 of the Hindu Marriage Act, 1955, read it:-

Unless the complete history of the Hindu Marriage applicable to the parties in question is checked confirming that whatever ceremonies were performed between was legally sufficient for the valid marriage between them, no further comments can be passed on such marriage %26amp; its legal validity.     Not under the law it isn't, but its my opinion that when two people love and are totally each others, in God's eyes and in their heart they are. That doesn't make a difference to probate courts if one of them dies or other things that matter if your single or married. Only a legal license will make it lawful.

    I just had a court house marriage and the steps I took were:





    1. i went to my local vital statistics bureau office and applied for a marrage license. [[this cost me $40 and i needed a government issued ID and birth certificate]]





    2. i went back 3 days later to pick up the license.





    3. from there you can either:


    a) go to your local court house and request a judge to marry you or


    b) you can go to your local court house and appoint someone [[a friend or family member]] to marry you.





    4. after this you'll have to let them know the date you plan to get married.





    5. the court will give you paper work and the license back.





    6. you get married :) then you take the license back to the vital of statistics office. [[they take 1 day to process the license]]





    7. go back the next day and pay a $20 fee and recieve your marriage certificate.

    We aren't looking for religious marriage - we are looking for civil marriage. We aren't trying to make churches recognize our unions - we want the federal government to recognize them.





    There are over one thousand federal rights and benefits afforded to married couples, but civil unions don't get any of those. If my lover of 8 years was in a coma and he had instructed me (prior to the coma) to have him taken off of life support after two weeks if there was no sign of response, his parents or a sibling could totally override that request because, legally, I'm not related to him.

    Marriage =/= in a church. Marriage is a contract with the state, it's a legal standing. Sometimes it's performed in a church by a church official. Sometimes it's performed elsewhere by a justice of the peace.

    Civil Unions are progress, but they're not the same; they don't include all of the same rights, and that's really not okay.

As such, this contract must be allowable between any such adults. For the State to disallow this contractual relationship based on protected categories of gender, is nothing more than discrimination.


    The religious concept of marriage and the State view must be separate, and have been since the beginning. Some religions allow forced marriages, or polygamy. The State does not. From a government perspective, ALL marriages are civil unions. We simply call it ';Marriage'; for cultural reasons.


    So, keep 'marriage' in the churches, and let those churches do as they wish. Only government licensed Civil Unions are recognized by the State, and those must be allowed to all.

    Legally, marriage should be between two adults, reguardless of their gender. Just making it between a man and a woman is unfair and treats gays like second class citizens. Either everyone can get married, or no one can, and it should be taken out of the laws altogether.





    As far as the churches, it should be up to each individual church to decide whether or not to hold gay weddings. I'm gay and I wouldn't want to go to an anti-gay church anyway.
